1) Scope of Application

1.1 These General Terms and Conditions (hereinafter “GTC”) of

(hereinafter “Accommodation Provider”) apply to all contracts for the rental of apartments for accommodation purposes as well as all related services and deliveries provided to the customer by the Accommodation Provider. These apply to both consumers and entrepreneurs (hereinafter “Guest”) who conclude a contract with the Accommodation Provider regarding services presented in the online shop. Any conflicting terms of the customer are hereby rejected unless otherwise agreed.

1.2 Definitions:

  • “Accommodation Provider”: A natural or legal person who accommodates guests for remuneration.
  • “Guest”: A natural person who uses accommodation. The guest is usually also the contractual partner. Persons traveling with the contractual partner (e.g. family members, friends) are also considered guests.
  • “Contractual Partner”: A natural or legal person, domestic or foreign, who concludes an accommodation contract as a guest or on behalf of a guest.
  • “Consumer”: Any natural person acting for purposes outside their trade, business, or profession.
  • “Entrepreneur”: Any natural or legal person or partnership acting in the course of business or professional activity.

2) Conclusion of Contract

2.1 The descriptions of products and services in the Accommodation Provider’s online shop do not constitute binding offers but serve as an invitation for the contractual partner to submit a binding offer.

2.2 The contractual partner may submit an offer via the online booking form integrated into the website. By completing the booking process and clicking the final booking button, the contractual partner submits a legally binding offer. Offers may also be submitted by telephone or email.

2.3 The accommodation contract is concluded upon acceptance of the order by the Accommodation Provider. Acceptance may occur within one day by sending a written or electronic confirmation (email). If no acceptance occurs within this period, the offer is deemed rejected.

2.4 The Accommodation Provider may conclude the contract subject to full payment. The contractual partner must be informed of this requirement beforehand. Payment must be made no later than 30 days before arrival or on the next business day if the booking is made within 30 days of arrival. Payment amounts to 100% of the agreed price. Transaction costs are borne by the contractual partner.

2.5 The contract text is stored and sent to the contractual partner together with these GTC (e.g. by email) and may be requested at any time.

2.6 Input errors can be corrected before submitting the booking using standard input tools.

2.7 The contract language is exclusively German.

2.8 Communication and processing are generally conducted via email. The contractual partner must ensure that the provided email address is correct and that messages can be received.


3) Cancellation Fee

Upon booking, the full gross price becomes due in the event of any cancellation or modification. Free cancellation or modification is not possible. All cancellations, changes, or no-shows will be charged in full.


4) Prices and Payment Terms

4.1 Prices are total prices including statutory VAT unless otherwise stated. Local taxes may be charged additionally.

4.2 Available payment methods are displayed in the online shop.

4.3 A deposit of 100% of the agreed price is required at the time of booking.


5) Beginning and End of Accommodation – Withdrawal by the Accommodation Provider

5.1 Unless otherwise agreed, rooms are available from 3:00 PM on the day of arrival.

5.2 Rooms must be vacated by 10:00 AM on the day of departure. Late departure may result in an additional charge.

5.3 If a required prepayment is not made in time, the Accommodation Provider may withdraw from the contract.

5.4 If the guest does not arrive by midnight on the agreed arrival date, the obligation to provide accommodation lapses unless otherwise agreed.

5.5 The Accommodation Provider may terminate the contract up to 2 months before arrival for objectively justified reasons.

Travel Disruptions

If arrival is impossible due illness or due to extraordinary circumstances (e.g. extreme weather), the contractual partner remains obliged to pay the agreed amount. The Accommodation Provider will assist with insurance claims where possible.


6) Provision of Alternative Accommodation

6.1 The Accommodation Provider may provide suitable alternative accommodation if reasonable.

6.2 This applies, for example, in cases of overbooking or unusable premises.

6.3 Any additional costs will be borne by the Accommodation Provider.


7) Warranty

The Accommodation Provider must provide services according to agreed standards. Statutory warranty rules apply.

7.1 For entrepreneurs, the Accommodation Provider may choose the type of remedy.


8) Rights and Obligations

8.1 The contractual partner must pay the agreed amount plus any additional charges by departure.

8.2 The Accommodation Provider is not obliged to accept foreign currencies.

8.3 The contractual partner is liable for damages caused by themselves or accompanying persons.

8.4 The Accommodation Provider has statutory retention and lien rights over items brought in.

8.5 The Accommodation Provider may issue invoices at any time.

8.6 Guests are legally required to complete and sign the registration form.

8.7 Only registered persons may stay in the apartment. Unauthorized persons may be required to leave without refund.

8.8 Smoking and parties are prohibited. Violations result in a fee of EUR 1,500 plus damages.

8.9 The contractual partner is liable for costs caused by triggering fire alarms.

8.10 Access data must not be shared with third parties, except emergency services.


9) Liability of the Accommodation Provider

The Accommodation Provider assumes no liability for bicycles stored on the premises or in the courtyard.


10) Keeping of Animals

10.1 Animals are generally not permitted unless approved in advance.

10.2 Guests must supervise animals properly.

10.3 Guests must have appropriate liability insurance.

10.4 Guests are fully liable for damages caused by animals.


11) Termination of the Accommodation Contract – Early Cancellation

11.1 Fixed-term contracts end automatically.

11.2 In case of early departure, the full amount remains payable, subject to savings or re-letting.

11.3 The contract ends upon the death of the guest.

11.4 Immediate termination is possible for good cause (e.g. misconduct, illness, non-payment).

11.5 In cases of force majeure, the contract may be terminated without notice. Claims for damages are excluded.


12) Applicable Law / Jurisdiction

12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 For entrepreneurs, jurisdiction is Vienna. For consumers, jurisdiction depends on their residence in accordance with applicable law. The place of jurisdiction is agreed as Vienna–Donaustadt.
